Cinclus AI is an advanced language model service designed specifically for Nordic users, offering state-of-the-art AI capabilities similar to ChatGPT and other leading platforms. Our service runs entirely on self-hosted infrastructure within Europe, ensuring complete data sovereignty and privacy compliance.

These Terms of Service ("Terms") govern your use of Cinclus AI services provided by WAYSCloud AS ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

1.1 What We Offer

Cinclus AI provides:

• Access to advanced language models (LLMs) for text generation and conversation
• Document analysis and knowledge base integration through RAG technology
• Multi-model support with various AI capabilities
• Secure, self-hosted infrastructure ensuring data privacy
• Nordic-optimized language understanding and generation

We believe in:

• Open Access - AI technology should be accessible to everyone
• Data Sovereignty - Your data stays in Europe, under your control
• Transparency - Built on open source technologies
• Privacy First - No third-party access to your data
• Nordic Focus - Optimized for Nordic languages and contexts

1.3 Service Availability

While we strive for 24/7 availability, we do not guarantee uninterrupted service. Maintenance, updates, and unforeseen circumstances may cause temporary interruptions.

2. User Registration and Accounts

2.1 Account Creation

To use Cinclus AI, you must:

• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use

2.2 Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your login credentials

• Engage in fraud or deception - Including impersonation or misrepresentation
• Violate intellectual property - Infringing on copyrights, trademarks, or patents
• Compromise security - Attempting to breach, test, or circumvent our security measures
• Distribute malware - Creating or spreading malicious software
• Spam or abuse - Mass unsolicited communications or service abuse
• Reverse engineer - Attempting to derive source code or algorithms
• Resell without authorization - Commercial redistribution of our services

3.4 Content Moderation

We employ automated systems to detect and prevent misuse. Violations may result in:

• Warning notifications
• Temporary suspension
• Permanent account termination
• Legal action where appropriate

4. Intellectual Property Rights

7. Disclaimers and Limitations

Cinclus AI is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose

• Uninterrupted or error-free operation
• Security or data integrity beyond our stated measures

7.2 AI Limitations

Important: AI-generated content may contain errors, biases, or inaccuracies. Users should:

• Verify important information independently
• Not rely solely on AI output for critical decisions
• Understand that AI cannot replace professional advice
• Be aware of potential hallucinations or false information

7.3 Third-Party Content

We are not responsible for any third-party content accessed through or referenced by our service.

8. Limitation of Liability

8.1 Maximum Liability

To the maximum extent permitted by law, WAYSCloud AS's total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8.2 Exclusions

• Damages from service interruptions or data loss
• Actions based on AI-generated content

9. Modifications and Termination

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WAYSCloud AS regarding Cinclus AI.

10.3 Severability

If any provision is found unenforceable, the remaining provisions shall continue in effect.

10.4 No Waiver

Our failure to enforce any provision shall not constitute a waiver of that provision.

10.5 Assignment

You may not assign your rights under these Terms without our written consent.

10.6 Force Majeure

We shall not be liable for failures due to circumstances beyond our reasonable control.

11. Service-Specific Terms

11.1 API Access

If you access Cinclus AI via API:

• Rate limits may be enforced
• Commercial use requires separate agreement

11.2 Business Use

Organizations using Cinclus AI should contact us for enterprise agreements with appropriate data processing terms.
